ACD Tas Member News: New NDIS Bill passed by Parliament

Dear ACD Tas Member,

Are you that you are looking forward to the longer days and warmer weather? We hope you and your family are well!

Have you heard about the recent changes to the ‘Getting the NDIS back on Track’ Bill that were passed by Parliament on 22 August 2024? This is a following on from the reccomendations of the NDIS Review reccomendations, which looked at the NDIS design, how it works, and how to make sure it can continue into the future.

This may create more questions than answers for you as we wait for more information, but here’s our quick rundown.

The laws will be officially enacted 28 days from when they passed, so changes will start taking effect in mid to late September. Some changes will be enact with a new plan, while others, will be implemeneted further down the the track. There may also be transitional rules, ahead final rules being approved by the states and territories.

For now, everything will continue as per the current guidelines. 

Changes that may come into effect sooner: 

  • Eligibility for Access : There will be clearer guidelines on who qualifies for the NDIS, this will affect those who are applying for access to the NDIS for supports. 
  • Clearer Rules on NDIS Supports: It will be clearer what the NDIS does, and does not fund, which will help us make more informed choices about what we can use the funds for. 
  • Impairment Notices: You will at some point receive notices detailing the impairments related to your NDIS access, which will help in better understanding your supports.
  • Plan Management: You might notice changes in how plans are managed and how funding is allocated. Plans will include specific funding periods, making budgeting and tracking easier.

Changes that may will be introduced later:

  • New Participant Pathways: When new pathways are developed, they’ll be designed with your needs in mind, especially for early intervention.
  • New Planning Framework: The framework guide how people can access the NDIS, how their needs are assessed, and how flexible budgets are created.
